If you agree on the kids and neither of you want to fight on the complicated finances more power to you. I’d look into getting a mediator or an attorney who does collaborative divorces (whatever they have in your state) to help put something together. As a general rule spousal support can be waived and assets can be split however you chose. Even in a community property state that’s not entirely how that works. Who’s on the mortgage and the deed doesn’t actually matter all that much. If you bought the house prior to the marriage you might be solely entitled to the equity from prior to the marriage. If you refinanced and took money out that probably becomes a more complicated question and if you took money out of the re-fi and spent it on something else that money is gone. The details matter. My wife and I separated and she moved out nearly 7 months ago. Since then, I haven’t had a day that I haven’t seen my kids (5 and 7) and I wouldn’t want it any other way. Definitely talk to your accountant. The short of it is, if you owe X you can structure your payment of X in any way you want. The complicated part is the tax piece for your business and I wouldn’t want to fuck that up.

No she can’t make you change plans. Look at it this way, she just happens to have “inside information.” As a general rule, your ex spouse can’t call up your employer to find out what your healthcare options are. None of her business. Of course, she still could try to make your life difficult over the doctor issue.

Don’t take this the wrong way, but you’re getting screwed because you didn’t realize the legal ramifications of marriage going in. The legal side of marriage presumes shared finances. Period.

Most of the commenters hit on it, but the short of it is that child support is never final and can always be re-visited. Two parents who agree can do what they want, but child support disagreements always go back to court.
