Claims is not gender discrimination, because men are "not a protected group".She is nuts for referring to her employees as penises, not for arguments her attorney makes in a legal defense. I would not attribute the legal theories that an attorney uses in defense of a client as the person opinions of that client. Attorneys are required to put up a defense. In the realm of hypotheticals any defense works, but prosecutors and police are sometimes very good at evidence. Lying would get you an obstruction charge if done during the police questioning, it will get you a perjury charge if done in court. DNA testing is ONE way to prove or disprove paternity. The law is weighted towards finding of paternity for spouses of the mother under the theory that it helps maintain stable family units. If the spouse of the birth mother signs the birth certificate (meaning he accepts paternity) then he is legally the father in most states. I guess that is how societies like this get started. First they look at the the worst social consequences of a reasonable public behavior. But then they decide that they only way to ban all the social consequences is to stop the behavior itself.
