My proposal is to make no change that would encourage an attacker to counter-sue their victim. Considering the tiny percentage of rape cases that are successful, a majority of rapists walk free and face no punishment for their crimes, and encouraging them to further attack their victims with litigation is just not a reasonable suggestion. The chances of getting a conviction against your rapist are extremely low, the prospect of facing your attacker in court is extremely daunting, and the promise of a second court case where you have to defend yourself again from your attacker is going to be a deterrent. Would you press charges against someone who attacked you, if you knew there was a high likelihood that they would be found innocent and could just press charges against you in return? As I mentioned above, making a rule to punish accusers if they can’t prove their case will lead to counter-suits and a decrease in reports. And yes, what we’re talking about IS allowing accused rapists to counter-charge accusers with “making false accusations” if they cannot prove their case. OK, picture this scenario, someone presses rape charges and is unable to prove them. The accused countersues, claiming it was a “false accusation”. One of them must be telling the truth and one of them must be lying. It will absolutely decrease reporting of rape if we start jailing anyone who can’t prove their case. This is a completely reasonable concern. Also we hardly punish rape as it is, so what are we going to do, just tell every unsuccessful/disbelieved accuser that we’d send them to jail but we don’t want to “ruin their lives”?
