Outstanding article. I disagree with one small point: It’s not biological, it’s a social construct, as many feminists like to say I'm certain it's a combination of both. There were biological reasons men tended to sacrifice themselves for women. That doesn't go away so easily. It's just massively reinforced by society now. The police turned over what evidence they had. The article doesn't indicate the police or prosecution withheld anything. The victim just gave edited records, and the police didn't conduct an additiinal search for the defense. Which is the defenses legal duty. Pretty much what williemaize said, but the civil suit and criminal appeals process are entirely separate with different burdens of evidence involved. The lawsuit would be much easier to win than the appeal (because of the lower evidentiary requirements in civil suits) and so it would actually be possible to remain in custody (lose your appeal) but win in civil suit (by proving the cop broke the civil law). Not a likely scenario, but technically possible.

In the U.S. it would be a slam dunk case. We have very specific case law regarding a cop's requirement to locate and include exculpatory evidence in an investigation. Even when a suspect is plainly guilty (and found guilty after appeals) the lack of exculpatory evidence being presented at trial is still a civil tort and damages have, and will continue to be, paid out to those that are affected.
