What's going on is also a great example of statutory interpretation run amok. The actual Title IX law of 1972 just says colleges can't discriminate based on sex if they want federal funding. 40 years later, colleges are holding their own courts to adjudicate sexual assaults. Probably not what Congress had in mind. As a law student who has studied this issue at length for class: Yes. This is the correct answer. It isn't just DOE though, it is mostly driven by the White House's agenda.
