This one also seems like an imbalanced comparison. Whoever spends the most time with the children, or is most responsible for them, is also most likely to do everything ever. If men and women on average spent equal time with their children across the board, it would be a fair comparison. But given a lot of times the roles are such that women are with the kids more, all of these things are inherently likely to be true. It's like saying "Women feed 90% of the junk food to kids." Yes it does. The principles of law are the philosophical principles of determining wrongdoing. If my standard has a basis there and yours doesn't, that means my standard is better. Your standard doesn't have a basis anywhere.

No you absolutely measure the degree of violence by the aggression of the perpetrator. You measure the damage by how much was done. And what matters is damage done. If the law applied your standard, lawyers would argue based on % power used. But that's not the case. It's all about force/damage and intent. You have it backwards. The abuse has been the other way around and her behavior was unwarranted. Any evidence she was abusing him before? But what you see here is she struck him first, twice. She barely hit him, but in same context, he barely hit her. Even though her strikes didn't affect him much, she still hit him as hard as she could.
