You don't lessen a charge in a court room, you're not allowed. Charges are already done and dusted before they go to court by the CPS. I don't know what to tell you mate. You keep shouting the word GUIDELINES like it means TOTALLY SUBJECTIVE but that's not how our legal system works. In the UK, each crime has a minimum sentence. Then the facts of the case are weighed against certain criteria known as aggravating factors. Every crime in the UK has sentencing guidelines which breaks down in stages what it takes to reach the next threshold. That's literally how sentencing works- the judges follow the aggravating factors qualification. The charge for a woman is called Assault by Penetration and has the exact same sentencing guidelines including minimum and maximum sentencing.
