Liberty is a legal concern because it is a political truth. As such breaches of liberty can ultimately be boiled down to a prosecutor and a defendant. The defendant can defend his preconceived views of personal liberty infringement (like you were saying) and that’s great, but a defendant scrutinizing the prosecutor’s rationale to reveal discriminatory intent is just as valid.
