23 and Me is garbage, they're a privately owned company so they can basically say whatever they want. According to them, twins have significantly different genetic ancestry, so there's no chance that a court of law would accept them as real evidence.

I've actually thought about this before. A and B are father and mother to a male, whose last name is A-B. Then A-B marries C-D who had father C and mother D. The child from that couple is named A-D, with A-B passing on his father's name and C-D passing on her mother's name. If you have a same sex couple adopting a kid, the child's name would be A-C for gay boys and B-D for lesbos. I'm not sure if anyone actually does this but it would work.

The average 13 year old shouldn't have sex at all. Since they are presumed to not have the requisite agency to make the decision, they also shouldn't be penalized for it. The general idea is that if you don't have the power to do something, you shouldn't be held responsible for the consequences. Children aren't considered responsible enough by the law even to sign contracts until they're 16, so it's internally consistent to extend that reasoning to sex.
