They are different crimes. It would only be double jeopardy if they tried her again for 1st degree murder. I know it seems like they are super close but the law sees different charges as different crimes regardless of how similar the charges might be. Are you and your wife on super bad terms? As far as I have seen, there hasn't been a whole lot of lawyers involved; both parties are pretty much in agreement about how everything is to go down. It's just that the law is the law so each is riding out the 6 months on their own until the time comes to make it official. But there is no real world consequences otherwise. I think, considering your goal of a 50/50 split, it's the same strategy. You have no way to know for sure what the other person might aim for, and since you know you would aim for 50/50, your best bet is to be the person most involved in your child's life and simply offer a 50/50 split. If your So argues against that, you have all the ammo you need to make it happen anyways, and if in the more likely scenario he accepts that, then it's just win-win.

Fair enough, although I find it hard to believe there wouldn't be someone out there without any interest in men's or women's rights. I could find several of them right now. I'm not asking for a robot, but it would be nice to have someone who holds every single page to the same standard, regardless of anything else.
