This is interesting but wasn’t the obligation to raise the child made to the child when it was conceived by the parents? If there is an obligation to the child, how is that voided by the actions of someone other than the child?

There are more reasons than that to be paid up front. In Canada at least the successful party is usually only entitled to partially indemnity costs, which amount to around 40% of the actual costs incurred. Secondly, a court ordering costs is way way after those costs have been incurred in preparing the motion for the court. Then, even when ordered, it can actually take quite awhile to collect those costs from the other party.

Well this actually isn’t an example of an unfairness that we should change. Even if a 16 has a kink for an older partner in a position of power, we should not be changing our laws to facilitate that relationship. As a society we have already determined that harm of allowing individuals in positions of power to have relationships with those subject to their power to socially undesireable. You just need to read what I wrote. Irrelevant to enforcing the judgment. As in the Court is functus in respect of the judgment and it doesn’t matter what she says. Aside from being irrelevant, a man could also make up false statements when a legally owed debt is enforced. I have seen it twice in May in Court. The judges don’t care.

Possibly but that is irrelevant to enforcing a judgment of the court. The only real options are to appeal or bring a motion to set aside (if she meets the legal test). Even if she was successful, he should request that the Court order her to pay the money into court before she can make any other submissions to the court.

You find her (or any judgment debtor) and serve them with a notice of examination in aid of execution. Obviously she will not show up to the examination so you would get a certificate Iof non-attendance. Then you would bring a motion to compel her attendance at another examination. If she does not show up for that one, you can bring a motion to have her held in contempt of court with remedies which include a warrant for her arrest to force her attendance before the court as well as longer period…

Do you not know how the legal system works? He got a judgment. Now he has to enforce it - there are different ways that it can be enforced. All he has to do is hire a skip tracer to find her. It would be the same for dude getting a default judgment against him.

This seems like an edge case and pretty extreme. Forensic evidence would also help if there were allegations of drugging. But in any he said, she said situation, forensic evidence is unlikely help.
