As I said earlier, it was decriminalized in new York, meaning you had to have a significant amount on you. It isn't just about who uses. It's about who distributes, which would be what is illegal in NY. Further, a weed charge in NY at that time is likely something they would use to keep them off the streets while they compile a larger case.
