On the other side of it, we also can't just pander to the "she was probably just lying" defense of men. It's extremely important, in terms of justice, not to be blinded by passion or sympathy. Those things are great for starting a revolution, but in a court of law where it's one against another, especially in cases like this, where it boils down to he said, she said...it offers little

I trucked through her victim statement and one author's heavily MRA interpretation of it. Some of the things the author points out seem contrived, but one thing I do agree with are the contradictions in her story. First she claims he couldn't have asked for consent because people never do that, then she claims he should be demonized for not asking for consent. The problem is that her testimony is contradictory. It's still up for debate whether she remembers and just wants to cover her tracks or doesn't remember and just wants to demonize him so as to not feel guilty for getting smashed and fooling around with another guy.

Yes, but that's also because she wanted a settlement. When she didn't get it, she claimed she never said she didn't want him to spend time in jail, and the sentence was too light and was, in her words "a slap in the face to me and all other women"

That's fair enough, i guess. The transcript of what took place in the courts just reads a little differently. First he didn't hear her cries to stop. Then she was unconscious. Then these bikers came upon him in the act, then they found him near by. Then he was raping her then it was just a finger, then it was a bottle and pine needles. Again. My only argument to that is that judges are human. A judge's decision can be just as flawed as anyone else's for any number of reasons, either way. I dunno...it frustrates me.

They SAY he ran. Then held him down. The whole thing might have been a revenge setup. That's what I mean. I don't know what happened but I don't think it's right to trash people who question a court's decision.
