She said they are both in the same stand point emotionally, but physical damage may of been caused to the girl thus giving grounds for a higher sentencing. She isn't saying that it's worse when a girl is raped, she is just giving a potential reason for the sentence difference.

That is a fair point, if there was physical damage to the girl than you are probably right on why the sentence was higher, and we don't know if there was. I guess in every situation there is bound to be variables.

I just think the "well they may of still done it" mindset is toxic. I understand there is no black and white answer to the punishment for false accusations argument. If someone did lie about rape and they receive literally no form if punishment that can lead into the dangerous environment we see today. Problem is, you can't distinguish between false allegation cases and ones without sufficient evidence. You know there is such a thing as innocent untill proven guilty. If there isn't enough evidence to prove the supposed assailant guilty, than they are innocent. The mindset of "they may of done it but there just wasn't enough evidence" is why peoples lives are ruined permanently even if the judge said not guilty.
