If she becomes a legitimate victim, she should be allowed due process and equal protection under the law Currently, yes. My point would be to change that. Her history should still be taken into account while the case is being investigated, and the entirety of the case should be reviewed and placed before the DA and hopefully a jury Actually, many times judges will prevent history from being discussed in court. Again, my suggestion would remedy this problem.

Whether the student was a male or female many (including me) believe that at 15 the student is able to make his/her own decision. Yes, the teacher should be prosecuted, not necessarily because of his age but because she was in a power of position. As others have stated, if the 15 year old committed murder most wouldn't think his age should prevent him from being tried as an adult and living the rest of his life in prison.

But he was later released without charge after police uncovered inconsistencies in Samuels's story. Inconsistencies? What were they? CCTV from the Last Post and a nearby off-licence showed no sign of Samuels at the time she claimed to be there, and the friends she claimed she was with on the evening were found not to exist. Yeah, that's a hell of an inconsistency. Fuck. How did she think she was going to get away with it? I feel sorry for those 4 children.

Judges have the right in certain states to block certain people from bringing civil suits against people because they have abused the privilege. This is just one more step above that.

That's why we would still give them 2 other chances to learn from their mistakes and to understand calling wolf would only make them a target, so they won't do it again. Putting them in jail is just costing tax payers money and could potentially make them worse criminals when they are released.

At 15 years of age I don't think even if the genders were reversed would a sentence of up to 25 years be acceptable in a statutory rape case. The State was just pissed that she didn't take the plea deal and made everyone go through a trial. The judge agreed with them. Boom - her life is over.

His crime was banging a drunk chick. It was consensual, but she the court decided that it was rape because she was too drunk to consent. From my understanding there was no BAC that was used evidence of her level of drunkenness. The decision was based on CCTV footage. His life was destroyed, and I see no reason to run it more.
