And many men do. In my district it’s 3-2, so three of the judges tend to award primary custody and two of them look to do joint. So there are plenty plenty of men who get joint physical custody. All men will get joint legal custody unless there is abuse involved.

Okay, one obvious situation where I can give it to you, if you are being abused, the sooner you file an action asking for a restraining order, the sooner the court hearing for that will be set. So the sooner the better. Which necessarily means filing before the other. But if both people filed on the same day it would make zero difference who was the plaintiff or defendant.

So if you get an award of joint custody it’s literally one week with you, one week with the other parent. Now if mom gets primary psychical custody, you’ll get a schedule of parenting time. The typical visitation schedule for a noncustodial parent in the US is every other weekend, Wednesday evenings, half of every school break and alternating holidays. And you can speak with them on the phone for 30 minutes a day.

Texas. Every single state in the union has the same laws around custody. That’s is, whatever is in the best interest of the child, is what they are going to do. That’s the standard in Alaska or Maine or Florida. Which is why it can be so judge dependent, because there isn’t any law that states specifically what they are to do. And the judge is never going “to assume”. They are going to listen to the evidence presented in trial and make their ruling through that.

I mean if one party violated the agreement and just took the dog away, the judge might award you attorneys fees for having to bring this to the court AND give you 100% custody of the dog. If she looks really bad in what she did. And everything in family law is drama inducing, so that’s just an accepted part of the practice.

Honestly it depends on the judge. Some judges just as a matter of course don’t give out joint custody because they think it’s bad for children to have two homes. But then there are some that are open to joint custody as long as you don’t give them a reason not to be. My advice? After you file, you can file a motion for sanctions. No the judge just said wife gets house and has to pay him out 35% of it. He also had to pay all her attorneys fees. I’ll be honest I have zero understanding of how community property states do their thing. So you’ll have to ask one who practices in one of those states.

When a divorce is between a couple with no minor children, there’s zero gender bias. So assets I wouldn’t worry so much. Custody is where the bias comes in. And it depends on the judge. It’s also a good thing on the other end. If you were wealthy and only married two years, the judge isn’t going to give half of your assets away. If their weren’t any kids they will probably just give the spouse 50% of only your earned income those two years

I’m in an equitable distribution state as well, which is most of them. Which means the trial court is not looking to split things equally…. But equitably. It gives them a wide range of what to do with assets. Some people can get through it on 10k. Unless there’s a massive battle. I’m in one right now for a client. But if we lose on this issue in trial it’ll cost him $150,000. So he figures it’s worth it to spend 20k in legal fees to fight it and hopefully win (which we will)

Don’t pay the alimony. Pay the child support and health care. I’m an attorney irl…. If she brings you back into court for contempt just ask for her finances in discovery and show she’s with a new man…you’ll be just fine. They can garnish wages for child support but not alimony.
