| – | Sign guysActually the vast majority of dated law uses "he" to mean he/she as it saved on the variables but was previously considered an easy way to describe an offender in an offence. More recent rulings use "a person" but to go back and sit each law through parliament for a rephrase is very time consuming. Rape as per the offence wording requires a penis so it is a "he" offence.
