So if you set it up prior to marriage, those aren’t marital assets? I’m still confused

Why not just set up a trust before marriage? Why are the parents the middle men?

Wouldn’t you lose custody as “not the father” on a paternity test, NAL so don’t quote me. The point of it is to establish you either are the father or not. If not the father and you don’t need to have parental rights, it may help you dodge the child support but you’d also have no parental rights to visitation for a child you say you love. This may also depend on the state some states make an assumption that even raising the child and being the “father” figure for an extended period of time makes…

Thanks for clarifying the language, I meant if he is in a state with fault being an option it can matter.

Depends on the state, in no fault, cheating doesn’t sway much of anything. If it’s a state with fault the cheating can matter for alimony but only if it’s very proveable like evidence backed. Last thing you want is to do is sling mud at your coparent if you can’t back it up. Child support is a totally separate issue and is typically awarded to whoever has primary custody of the children, or even in 50/50 custody, some support can go to the parent who makes less money between the two. Essentially…

Well a short marriage and large amount of debt should be enough to prove you don’t have the ability to pay alimony. Is your STBXW expecting or asking for alimony? Does she have an attorney? Are you both self represented or planning to do mediation?

Spend the money on a good attorney now to hopefully avoid it. But the outcome is very dependent on your state laws, in many places a 4 year marriage is not long enough to warrant alimony. In addition, I believe many states are moving away from alimony under the assumption that your stbxw is able bodied and able to work and provide for herself after the division of assets. Like I’d expect her to take half of everything, but depends again on the state. But at least half of everything acquired duri…

This is great advice if it’s a single party consent state, 2 party consent state recording especially in a private residence could get you in trouble but potentially less trouble than the false allegations if they do come out. So probably good advice either way

Can you take a HELOC out and use that money to buy her out? Not sure if it would work for the situation or change the payment compared to a new mortgage/refinance. Not sure what options specifically the VA loan agent went over. If the VA can’t help you maybe try another lender or a few to get your best options?

Depending on the state service by news paper or some sort of ad is an option as well if you’re unable to locate her. I’d start looking into this just to have all your options

This! Talk to a financial planner or lawyer about putting inherited property into a trust or see if your parents can place those things into a trust and you will inherit the trust you’ll win with lack of taxes on those properties and assets too

Unless court order says otherwise, in a public space there is no expectation of privacy. If your court order has a “no recording or surveilling the other party” then this could be an issue. I’d recommend going straight to the police station next time and refusing to interact till inside, but feel free to film in public if she’s coming up to you

This is something a personal attorney should be helping you with. Did you have a divorce attorney?

Attorney asap, don’t violate the restraining order, don’t do anything that would make you look worse. File to establish custody and ask the attorney about pressing charges for false reporting and potentially perjury by your wife.

You’ll need proof of the abuse allegations if you want to use them on court. Alimony is hard to get awarded with both partners working and have similar pay- especially if you’ve been splitting costs down the middle- your “lifestyle”/budget isn’t really being affected by divorcing. But mainly it’ll depend on the length of the marriage, the longer the marriage the more likely they will award alimony. Splitting finances isn’t abuse. Her working fewer shifts is gonna just show she prioritizes the ch…
