We went 50/50 for a while via mediation (didn’t go to trial). An hour isn’t the worst drive. Then we mediated into my daughter going to school in my town (I basically left child support the same in exchange). It’s fine. I’d rather have full custody. But it’s okay and, you’re correct, it’s stipulated she can’t move any farther away. To sum: we mediated outside of trial. And I was always proactive to initiate so I’d get what I want.

Best advice: be a good dad. Insist on your rights. Be civil. Find a good lawyer who can advise you along these goals. A lawyer doesn’t mean you have to fight; it can just mean good counsel so that you can respond well. I can’t provide anything other than that. Don’t know about annulments. Had a relatively bad divorce but came out with 50/50 for now (2yo daughter).

I don’t know if this is possible for you... but our lawyers did a hearing with the judge where they asked what the judge was likely to do with custody (50/50 or place majority). If you can do that, find out if the judge is likely to place 50/50 if there’s no major problems. If so, maybe you can go to trial on just that one aspect. Or if she knows the judge is likely to rule that way, maybe she’ll agree without trial.

Why wouldn’t you follow the advice of your therapist? It’s kinda like, “My doc said not to walk for two months after breaking my leg, but that’s not gonna happen. How long y’all wait?” I would ask my therapist for a non-boiler plate recommendation. Ask what you should be looking for in your healing journey.

Consult a lawyer. But conventional wisdom would say you split it the same way you split the credit. If you haven’t finished your decree yet, write that in. (I did.)

I disagree with your view of the world and people in general, but you have your answer. Go file. If you can, get as close to an uncontested divorce as possible. Mediation is a great tool of you disagree and need to find a way to compromise.

Therapy was my first thought as well. You paint her as insecure, but also hopeful. That combination tells me that maybe she’d be really committed to working on your relationship in therapy — if you are.

Begin as you intend to finish. I recommend trying not to turn it into a fight. Bring it up. Mention mediation as a way to solve the points you don’t agree on. After mediation, ask your own lawyer to review for their feedback. (Most mediators can produce a decree based on what you decide that a lawyer can review.)

My daughter is two. My wife also moved an hour away. I would suggest not making a decision now based on when he’s in school. So much can change. If you want 50/50, fight for it.

Please just take a moment to recognize that, and to tell yourself that what you're going through is really tough. Although it's not your fault, you have made some very unwise decisions here. Here's what my lawyer told me yesterday: if you and your wife agree to it, then the courts are likely going to approve it. They want you to make decisions together as much as possible. Given that, I wouldn't do anything until it's in writing and signed. It just makes it easier. So yes write it up. Yes get a lawyer to review it. No, don't actually do it (including the refi) until it's been signed.

I have two pieces of advice: Identify your values, and what is most important to you. Make your decision based on that. My guess, based on your post here, is that you have values that may require you to stick it out a little longer. But that you struggle with if that is even worth it. If it's true to your values, then it's worth it. If you stick it out, find an agreed definition of "work on things". Don't leave it nebulous. Decide that you're going to counseling, etc. Whatever "work on it" means…
