I have a very similar situation with 2yo and 4yo and wanted 50/50 custody. I could make a lot more by being 4 hours away so actually stay in a hotel 2 nights per week to make this work. Luckily I have a decent sized nest egg so working was optional but important to maintain excellent health care for my kids. Given your situation I would not trade those priceless experiences away if you can figure out a way to make it work at all. I fear if you move away, you will have the kids less, and likely y…

from what you describe here, I hate to tell you but there almost certainly is someone else she is either interested in or has already been involved with. I feel for you man since was married almost the same amount of time and have a 4yo and 2yo. Absolutely get a good lawyer NOW and prepare yourself. Seriously do not wait one more day. What she is doing is not legal but you need to make sure you approach things correctly so she doesn't flip anything around. Do NOT move out of the home. Do NOT agr…

I'm assuming you have offered to go to counseling and that ship has sailed. If so she has made up her mind and nothing you say or do will change that. Time to start thinking about the kids as you heal. Get a lawyer asap to know your rights. Make it clear and fight for 50/50 custody. Especially if you plan to keep the house but do NOT move out without consulting your lawyer. Mentally prepare yourself that no matter how nice she is being now so saying she will be, things will get worse as custody …

only doing it for the kids and no way was giving up the house. I knew she would drag her feet on the details even though she was the one who called for the divorce to blow up the family in the first place. Seriously the not knowing how long it will take is mentally draining. Hanging in there though. Best of luck to you though.

My STBXW doesn't like making a decision. Its very strange right now for me since her lawyer is clear to my lawyer that she is waiting on her to make a decision. So awkward and the waiting is the worst. I don't suspect she will switch lawyers but she doesn't have a lot of incentive to divorce quickly even though we have met the separation year yet still cohabitating. Very awkward and not knowing when it will end is the worst part.

My lawyer helped me strategize this but it's not signed yet. I'm getting 50/50 custody (equal parenting rights) but my kids will stay with me 3 nights per week and 4 nights per week for her (this works with my employment). To makeup for the difference in days, asking for a week in a specific month every year, so perfect vacation planning time. The court will look at it as what is best for child and not what either one person wants. She absolutely does not want to have odd/even holidays because h…

First off I'm not a lawyer so you should have one and have them explain it to you but I have a similar setup with number of nights (mine is 3 nights per week while she is 4 nights per week, so I can make it work with my work schedule) and I had much these same concerns. you are likely correct in how the shared custody formula will be applied since your incomes are disproportionate but you can have an arrangement like this and still be considered 50/50 in the courts eyes as far as how decisions a…

A lot of what you say here I can relate to. Within two days of my wife telling me she wanted a divorce I had a lawyer to know my rights since 50/50 custody was the most important thing to me. If you don't have a lawyer yet, absolutely get one. I don't care how cooperative she seems now or you think you don't have the funds, find a way to get representation. This is not something you want to mess up and can/will have ramifications for years to come. On the bright side the law is on your side so 5…

She decided not to fight me on the house. I'm not sure why but likely because she knew that was something I'd go to court over. I moved locations/jobs to be closer to her family and she initiated it so no way in hell was I giving up the house stability. I paid every single mortgage payment but the courts don't care about that. Ironically I'm more plugged in with the neighborhood dad's that me moving away would have hurt our kids relationships. Also she knew that I was the only one who could keep…

4 months would be amazing. I'm on month 13 here. It's crazy how much things are tangled like you said and exponentially if u have kids.

They take for granted what you do for the household and in their minds really believe they "do it all"

I'm paying Health Insurance and HSA for the kids anyways which have no issues with. She will remain on my policy till the divorce is final. We've always had separate cell phones so no issue there. The only thing that irks me still is one of my credit cards which I added her as an authorized user which she uses for free groceries and gas. The groceries I don't have an issue since my kids eat them too but the gas for her personal vehicle annoys me. At this stage though, not worth rocking the boat …

Yup my lawyer warned me if I moved out even temporarily she could file for abandonment making it very challenging to enter my own home. I told my lawyer on day one (literally one week after my STBXW told me that I'd fight tooth and nail for 50/50 custody and the house with everything else open to negotiation

we have two kids. when my wife told me I made it clear that she was welcome to stay wherever she wanted while I take care of the kids (ie. making it clear I'm not leaving the house nor she can take the kids anywhere). She tried early on to complain about the stress and that I should move out but I made it clear that she was the one who was having the stress and I wasn't moving out for anything (I enjoy every second I have with my kids). I'm getting 50/50 custody and keeping the house (after payi…

I'm currently go thru the divorce now and it's almost hilarious how well she behaves around the kids now. She tries so hard not to yell and cus at them like she did for years. I know it's just because we are in a critical time in the final divorce process but hope it sticks after I'm not around to shield the kids during her 50% of the time.

wow I feel for you man. Who initiated the divorce? Not that it matters in the court's eyes but was just curious. Hopefully you have a good lawyer. Laws are different in every state so trust your lawyer but you moving out could definitely hurt your case if you want to keep the house and fighting for 50/50 custody. My STBXW gave me that BS and I told her if she was uncomfortable she was welcome to stay somewhere temporarily and I'd handle the kids. No way was I going to move out of MY house or lim…

not familiar with what a "collaborative divorce" is but no way would I ever pay a dime for my STBXW's lawyer. I offered to pay for a mediation session which was only $700 but the wife declined. I have my own attorney and she has a good reputation for not wasting time or money. I estimate when everything is completed I will have paid about 20k total to my attorney but that is mainly since the wife is not fighting me on 50/50 custody or the house, the only two items which I would have spent unlimi…
