I’m relatively new to this sub and everything, but the amount of stuff that has been plain common sense is startling. If something like the above example is plain as day, how come more people don’t see that? How come the legal system hasn’t changed to repair the double standard?

Unconscious or not, if he was drunk enough as well, he couldn’t be held accountable for his actions because he couldn’t consent. Sexual activity between 2 drunk people shouldn’t have a double standard, neither party should legally be able to be held accountable, since if a drunk woman can’t consent, a drunk man can’t either.

Here’s my main question, not about this case, but sexual assault cases in general. How come an intoxicated woman can cry rape, even if she asked for it, because she’s “unable to consent”, but an intoxicated man can be locked up as a rapist. Isn’t a drunk man also “unable to consent”? Seems like female privilege to me. Women can get a man locked up if she makes a drunken decision and regrets it, but even while drunk a man is held accountable and can be jailed for a drunken decision.

And had he actually had sex with him, she could've still pulled a crazy and pressed rape charges, since he had sex with her. Lose-lose situation, recording was the only way out.
