I disagree with your opinion that restraining order should be abolished. In cases where an abusive person would normally go to where the abused person is (like, if they lived together or something), it makes it easier for the police to protect a person who would otherwise get brutalized. Normally police have to wait for a crime to be committed before responding, and they certainly wouldn't arrest a guy for coming home. In certain cases, a restraining order can make it a crime for someone to be somewhere, which makes it easier for an officer to respond to a call. Normally they'd have to wait until a crime was committed, at which point the victim might already be dead. An RO violation is an on-the-spot arrest. This is especially useful if the abuser normally lives in the house where the abused currently is.

To be perfectly fair to the system, however, sometimes evidence is just... hard to come by. I took a big risk though, and I wouldnt advice anyone else to do that. Unfortunately, this is what everyone faces when it comes to cross-gender relations. Compare the chance of gaining an additional lunch-time companion to the chance of losing one's job. My main argument is against using bad language against individuals and against women as a whole. The reason isn't so that we don't offend them, it's because we're better then that. We all get screwed for this one. On appeal this will surely get turned over, which will very securely set the precedent in the other direction. It would have been nice for such a case to have been uncomplicated by actual rape.
