That's not something that should be taken lightly enough for it to be "case by case". If it's open to interpretation, then it becomes a dangerously slippery slope. So a fist fight breaks up, and the guy I was fighting with moves to leave the bar. Who's to say he isn't going to his car to get a gun? I fully understand that in Texas, he was within his right to do so. I'm not arguing law, I'm arguing morals. Getting shot in the upper back would also qualify as the torso, so no confirmation that one wasn't shot while fleeing, either.
