How would an accused man prove a woman said fuck me? It’s typically on the prosecution to prove beyond a reasonable doubt that the elements of a crime occurred. Laws stating that a defendant need prove something as ephemeral as “she begged me to fuck her” or go to jail for rape as a result of the MeToo process fundamentally erode due process. Legal can get complicated pretty quickly depending on the jurisdiction, and I’m not a family lawyer, but my understanding is that if a husband has a child he usually only has so many years before he can sever his legal obligations through contesting paternity. Even if he’s not a husband if it can be demonstarted that he “assumed responsibility” he’d be on the hook. I believe there are some exceptions assuming that the biological father can be determined.
