Because "no" isn't always said when someone doesn't want to do something (see the claim of sexual assault against Aziz Ansari, for one). In a scenario where you're dating someone and often have sex, married, or even just a FWB situation where you often have sex, etc. If something happens and one person then decides "you know what, last night I didn't consent actually!" and files a rape claim (say due to an argument and wanting to get back at you or something).
