Yeah, the UK is very different and honestly I have no idea why. “Alimony” (spousal support in the UK) is literally unheard of unless there is about a million pound difference in income. When childcare is 50/50 then there is no maintenance due either.

Sorry mate, he’s in the UK and the child maintenance service (CMS) absolutely cannot override a court order! Edit: Op - if you have equal overnights and day-to-day care (search online for the CMS decision makers guide for what that means) then you do not have to pay any child support at all.

Oh no certainty do not ignore it. My point was that if you have 50/50 and have equal day-to-day care then there will be no maintenance due. See my comment below with the actual text or have a look on the gov.uk website. The initial CMS letter always gives a figure assuming you have 0 nights, until you call them and give the actual facts. No, in the UK if he has 50/50 equal shared care then he absolutely will NOT have to pay a thing.

No problem! Here is the important part that is buried in the gov.uk website: Q: What happens if the day-to-day care of a child is equal between a paying parent and a receiving parent? A: In this situation, the paying parent does not have to pay any child maintenance for that child. I’m sorry to our American friends, in the UK there is no such thing as alimony and if you have 50:50 then no child support either.

You should probably post this in /r/legaladviceuk but I believe that no, they can’t override the court. I’m not certain about Scotland but in England if you have equal 50/50 care then there is no maintenance due. The CMS letter assumes you have 0 nights and you need to call them and explain the circumstances and then they will reassess
