A divorce court establisheing jurisdiction IS what common law marriage is. It's the legal term for it. Parental kidnapping isn't called that in legal terms either, it's called "child concealment" parental kidnapping is still what it is. If you're "effectively married" (as you said) that is infact what common law marriage is.
