Similar situation happened to me. We separated for two weeks before agreeing to divorce. The legal answer is "it depends"... However, most likely you both were entitled to half of the 401k and now half of the new house. It doesn't matter that you are the one who was paying for your current house, it's split between both of you. (assuming it was purchased after you got married) If you are going to be staying in the house and she is moving out, then yes, you'll have to pay her half of the equity in the house.

I don't know about screwed, but I certainly wouldn't pick her again. We had bad communication, and we both ignored our problems. I always thought there would be time to fix things later, but when she expressed wanting a divorce she was past the point of no return. So I should have had more serious conversations with her earlier and tried to get us to go to consoling. I'm not sure even that would have worked, we may have just ended up divorcing earlier.

I get the urge, but don't tell her that. That benefit gets removed with a divorce and you'll always be wondering if you can reconnect sometime down the line. It's hard to move on with that attitude. Unless you have kids together, no contact is absolutely the way to go.

Divorced is finalized but: - You still live with the ex. - Your ex still has interest in you. - You still do stuff as a family. If I'm someone you are dating, I'd think you aren't really past this relationship. I think you need to tell her as soon as possible. This situation is going to be a dealbreaker for many.

If you can prove you had $100k in the account before you got married, you should be able to keep that $100k after the divorce. (The burden is on you to prove it, otherwise it gets split 50/50.) If you can prove you had $100k in the account but also added more to it while married, in theory you can figure out what the gain is on that original $100k over your marriage and keep that too. If you have any assets from before the marriage, they can still be 100% yours through the divorce process. Make sure you hang on to them for now, because if you sell them the money will be considered a marital asset and split 50/50.

I'm in the middle of the divorce, but I'll be keeping the house and buying her out. We have no kids, and I like the house overall but I'm pretty sure I'll be better off mentally somewhere else. We moved in together and everything about the house is memories with her. I'll try to make some changes, but I don't think that will be enough. Financially it would be much better to stay here, but I think I'll be willing to take the hit to get a fresh start somewhere else.
