If there are witnesses or physical evidence. When there is no proof of who escalated, the police usually arrest both parties in most states. In some states they simply arrest whoever did more damage, but file no charges. The filing of charges is typically then up to the people involved. And I stand by it. I'm a man. I want to fight against stereotyping of men and I think I should have rights. I also want to fight against the stereotyping of women and I believe they have rights. I do not believe these two goals conflict in any way. It's not a zero-sum game, it's not a war. Sexism exists against both men and women.
