There are ways that you can alter a contract once it is signed. If they can prove that the parents gave verbal permission then this can act to change the contract. Well she admitted to pointing him out so technically she is an accessory. Her being partially responsible for his death is not a question of fact. She is not saying that she didn't do what is claimed, she is just trying to put up a legal defense of why she did what she claimed. The claim that he raped her is a question of fact since it was never tried in court. So it is proper to use alleged for him but not for her.

Negligent homicide involves a risk that you should have known but didn't. It would not work because her husband said it was loaded and gave it to her. This shows that she knew of the risk but ignored it anyway which would be reckless conduct and would justify the charge of manslaughter. Although if they can show that her reckless conduct involved a grave indifference towards human life, which the prosecutors very well may be able to show, then it would be murder.

I thought the (false) statistic that they usually used was 1/5 women will be sexually assaulted throughout their 4 years in college. So first, this lady shrinks that to 1/4, and then she says that it is 1/4 per year. Looking at the book, it seems similar to one of my law school books. If it actually is a law school book there is nothing they can do because they need to teach what the law is and not what it should be. In my criminal law class we discussed this and my professor went on a semi rant about how she doesn't think it's right but that's the way it is.

In general I wouldn't disagree with the ACA. It's the provisions that mandate that men must pay the same as women that I have a problem with. You don't see this with other areas of insurance. For example a young male pays 4-5x the amount that women pay for car insurance because they have a higher risk. I don't see why we should make it equal in one sense but not in the other.

It is not so much the higher prices that piss me off, although they still do. It is the fact that after clicking on the link I saw that tickets were sold out for males, but not for females. It is the limiting of tickets by gender that annoys me. People are basically being denied entry just because they are male. The difference I would say would be that "teach men not to rape" assumes that all men rape and that we need to be taught not to. The State Attorney Office’s said the case has sparked change in internal policy. It is terrible that this man was victimized like this but at least there is a silver lining in it. It is true that most modern divorces are "no fault" divorces which allows the couple to end the divorce for basically any reason. This does not mean that they don't take other factors into account in the settlement, it just allows the marriage to end. This is basically something that varies by state and if you have a decent lawyer, they can get infidelity to affect the settlement. Sometimes it works, sometimes it doesn't.

It has become so common for women to be allowed to wear whatever they want at work. Sure some places still maintain a strict dress code for female employees, but many places are much less strict. I am currently looking at a female coworker of mine who does the same job as me. She is wearing jeans and flip flops. I wear a shirt and tie to work everyday. I am in favor of removing the pricing structure depending on age. It can easily be replaced with a pricing structure that changes depending on experience. I am not sure of the legality of using it in a court room but I would think that it could be used to get the case thrown out before it moves to trial. The difference with your example between a politician and a private citizen is that politicians are held to a higher standard. For a politician to sue, they need to show that it had some noticable harm to them, not just their reputation. That is why I can go and say Politician X is a facist nazi loving racist baby killer. The same standard does not apply for private citizens. If I said that about a private citizen, the standard for proof of harm is MUCH lower since they are not a public figure.

Hm I missed that part about them lying. The only defense I would have for this is that in "Frazier v. Cupp, 394 U.S. 731, 739 (1969)" the Supreme Court stated that police officers may lie. They need to provide you with a written copy of the warrant at the time of search and I believe that is up to the person being searched to request this from the officers. I am not sure if that would hold up in this case, but there is a possibility that it could.

In that case the suspect was questioned while he was in custody. Therefore he was under arrest. The difference is that the suspect here was not under arrest at that time. Even though he was being asked questions, he was not in custody and could have left at any time. He asked if he was under arrest and the cops said no even though they arrested him afterwards for a different reason.

They didnt need to mirandize him because they said he was not under arrest. He was placed under arrest after that line of questioning. Also, they only need to mirandize you once that start interrogating an arrested individual. Since he was not arrested at the time, it does not count.

The age discrimination more applies to people that are older. In many U.S. states you need to prove that someone over 50 was doing a subpar job and that was the reason you fired them. Also, if you fire them for monetary reasons, you are legally not allowed to hire someone to replace them for that role. Note: This laws still apply in states that are right to work.

I played football for many years and have seen my fair share of injuries, including a teammate fracturing his neck. The protocol in this situation is to stay away so the proper people can get to the person. With my 0 medical knowledge what can I do for him? What I can do is get in the way and make it harder for people to do what needs to be done. Sure, I cared everytime that one of my teammates was inured, but "showing" that I care is not going to help the situation.
