AFAIK the idea was to give women the obligation to message first, taking away the power to just sit back and let men stress about the opening message. Then, the defendant's usual defence will be that headline was true, and the burden of proof then falls on the defendant to prove that it was true. "Misleading" doesn't mean "untrue". OPs complaint is that the article's headline refers to the women's struggle with no mention of the fact that men are facing a greater struggle. It's like similar headlines of "1/4 suicides are women", entirely missing the point that 3/4 of suicides are men. A statement can be 100% accurate and still be misleading.
