Because custody battles work so well with today's laws and laws themselves are peaceful, as opposed to rules with the threat of theft, kidnapping, or death behind them. Without laws, two parties that could not agree with each other, and wished to avoid physical conflict, would have to agree on a DRO (dispute resolution organization) that would rule for one party or another, or both to certain degrees, or whatever. You're thinking of state socialism, I think. "Socialism" can mean what you say, but the word is ambiguous. Some forms of socialism do not require government to function. State socialism is a pernicious system in which politicians make themselves "more equal" than others and live off the fruits of non-government people, while invoking "common good"--not much better than the fascist system of the US, in which government colludes with businesses.
