No the answer would be “it depends.” The rest of your answer states a rule. But your conclusion is not justified by the rule alone. You’d have to assume facts to reach that conclusion.

You’re mistaken. Imagine the following: “jack killed Jill. Is it murder?” There’s no way to answer that. He might have murdered her. But it might only be homicide. You’re confusing hypotheticals with burdens of proof.

There’s not enough facts to make that determination. It’s a fact sensitive inquiry. Presenting it with no facts, anyone who takes a position one way or the other is simply projecting their set of values on the hypo.
