Because of the ancient definition of rape that they refuse to change. If they aren't the ones penetrating it can't legally be classed as rape in most places. If she had pegged any of them, there may be a case to be made but in terms of law, judges won't class it as rape due to that stupid legal definition as it can be thrown out via appeal and make them look bad. The legal definition NEEDS to be changed. The sooner, the better. Still gonna be too late, though.
