There's nothing immoral about him deciding to sleep with her, which he can legally do. It's immoral for her to sleep with him. The issue isn't rape, it's an inappropriate relationship. Where I am the age of consent is 16 but a teacher can't sleep with you until you are 18 because they are in a position of power over you. I say good for him! And she should probably wait until her students are 18 to sleep with them.
