Yeah the DA can prosecute the DV on his own he doesn't need the witness. Happens to men all the time when people want to drop charges the DA picks up on it anyway. And it's very rare for them to agree to drop charges at completion of probation and classes. Or to defer a sentence and it be a misdemeanor. For example if it's a deferred prison sentence (anything longer than 365 days) it's almost unheard of It being deferred if it's a misdemeanor usually deferred sentences are for felony's.
