As an attorney, yes, it’s common to give yourself that option in the rep agreement but most that I know don’t change their rates more often than once a year. But depending on the case it’s not unreasonable to not want to get locked into a given rate if a case could potentially drag on for years with ongoing custody issues, etc.

Unless someone is trying to commit fraud I don’t see any legality issues. The parents can gift her the money and she can pay you, so there’s likely no issue with having the money go to you directly as long as it’s documented that the payment is on her behalf. But it should all be documented accurately and everyone should be on the same page for how this gets reported to the IRS. And there may be more tax advantageous ways of doing this.
