We’ll never know. SHE chose not to do as she was asked and told. If she does what is asked and he still dumps her on her head he’s the bad guy. That’s not what happened here.

The safest bet is when the police are detaining you is to comply. Even, and especially, when you disagree. If you’re guilty they’re going to take you anyway. If you’re innocent and they were wrong to detain you it removes any possibility of an obstruction or resisting charge and you have remedies after the fact. No one has ever willingly jumped into handcuffs for me, but the smart ones realize physically resisting only prolongs the inevitable.

"Plain smell" as it's called is enough for a warrantless search of the vehicle and occupants, at least in Florida. It's treated the same as if the officer looked into the car and saw something illegal. It wouldn't be enough for a warrantless search of a house though.
