Advice- We both want to keep the houseBro let her have the house, if she really wants it make her pay good money for it, take the money and run. You can get another house, either waiting until rates come down and the market improves or buy and refi later. A house is just a building. You can get another house. Don’t let the house stop it from being amicable. You might end up living in the house and cursing it. | /r/Divorce_Men | 29/12/23 11:04 AM
Advice- We both want to keep the houseI’m using goodwill as a nice word for leverage if that isn’t clear. For something like child custody though it often doesn’t work well to make it a straight economic trade off like that (“you can keep the house if I get 20% more time with the kid”). It can get wrapped up in a global settlement or bargained for indirectly though. Make the custody-related demand as part of the house-related concession. If she won’t give the custody the title to the house goes back on the table along with everythin… | /r/Divorce_Men | 29/12/23 09:45 AM
What to expect if there's not much money?Your link is broken. Here's a working one: https://caselaw.findlaw.com/court/nv-supreme-court/1994474.html | /r/Divorce_Men | 29/12/23 01:45 AM
What to expect if there's not much money?Nevada has no formula or guidelines for alimony. Just "factors" for the judge to weigh in their discretion. | /r/Divorce_Men | 29/12/23 01:42 AM
Paying RentIf anyone needs to reach your wife for some reason (bills etc.) while the order of protection is in effect and you are still unrepresented, if for some reason you feel like you can't ignore them, give them her lawyer's contact info, not your wife's direct contact info. This runs up bills and wastes time but that's not your choice. Keep your ass covered. | /r/Divorce_Men | 29/12/23 01:09 AM
Paying RentYeah. Can't be too careful. I'm sure wifey can figure out how to pay the rent if she's interested, or landlord can give a knock if he wants to find out why you're not picking up. If in fact you are loaded and keeping two landlords and two lawyer retainers current is no sweat in addition to unknown future maintenance (and child support?) obligations, then feel free to keep paying the rent before you're ordered to do so. Or if you're loaded and a ding on your impeccable lifetime credit score and m… | /r/Divorce_Men | 28/12/23 11:03 PM
Paying RentLet it go to voicemail. Don't tell anyone to contact your ex. I assume you have a no-contact order. | /r/Divorce_Men | 28/12/23 10:56 PM
Paying RentDon't pay until you get a lawyer you can ask or are ordered by a court. As of today you can't afford to pay it due to your need to retain a lawyer and find suitable housing. Don't take an action to positively remove yourself from the lease (you probably can't anyway and you don't want to do anything involving your wife that could violate a stay-away/no contact). Don't shut off utilities or anything. | /r/Divorce_Men | 28/12/23 10:52 PM
Advice- We both want to keep the houseMy advice is let her buy you out and use that goodwill to get more of what else you want that is important to you (time with kids, equity in distribution, etc.). You can't both keep the house. You will feel better about not keeping it when you've given it up and don't live there anymore and are no longer haunted by the past memories and conflicts there. It sounds hard because that's where you're at but this is one of the easier conflicts to resolve. Be glad she hasn't used the nuclear option. Be… | /r/Divorce_Men | 28/12/23 10:45 PM
What to expect if there's not much money? You're definitely looking at guideline child support and then some alimony. Nevada is all over the place on alimony and it doesn't look like they have a guideline or formula for it, but with a SAHM mom married for 20 years there's going to be some obligation there. She should have some income imputed to her with one daughter age 15, but you'll still end up paying her a chunk of change. Possibly for longer than you owe child support. At least in Nevada child support ends at age 18 (or 19/HS gradu… | /r/Divorce_Men | 28/12/23 09:41 PM
Am I being selfish/a jerk or smart?I just want to add that telling your wife you are filing and it's over is not surprising her. Surprising is what happened to me, having the cops call me to bring my kid to my house on a Friday afternoon and giving me 10 minutes to collect some clothes and get out, then having my wife's lawyer hand me divorce papers in the courthouse hallway the next week. With no discussion whatsoever beforehand. Having her served or find out from someone else is an asshole move. Telling her face to face that it… | /r/Divorce_Men | 28/12/23 09:21 PM
What to expect if there's not much money? With a SAHM wife and a 15-year-old kid, expect a lot less money. Your expectations are accurate. Consider a shack or trailer in the sticks if you can swing it instead of a room in the ghetto. Good luck. On the plus side you're only looking at 3-6 years years of child support, assuming you don't end up on the hook for college expenses, which hopefully under the circumstances of this shitshow you will not. You need to provide more info about where you live, your state at least, for any more specif… | /r/Divorce_Men | 28/12/23 09:14 PM
