It's equating knowingly operating a vehicle under the influence with being drunk to the point where you cannot give valid consent. There are two people involved in the decision to have sex. Either could be sufficiently intoxicated by their own choice, somewhat unintentionally, or by the acts of another, to (in the eyes of the law) be unable to consent to sex. The issue is consent and the advertisement (which is out of circulation) failed to give a balanced message. Consent is determined based on a variety of factors, including the degree of intoxication. There is nothing illegal about drinking and hooking up. It is illegal to drive while over a certain BAC.
