It's Ohio. There was another Ohio case on here recently with a rape. The issue is that many states have broader terms so they can apply more broadly. Ohio has a specific rape charge that includes sexual misconduct with a minor, while other states use other terminology, such as "sexual assault". Newspapers don't want to be sued, so they report the facts. That means that they report the actual charge, not their interpretation.

In Oregon, without physical compulsion, it's "rape" only if the victim is under 16. There are other terms for older victims, or other circumstances. For example, if the abuser is a coach, then the abuser could be charged under Sexual Abuse in the Second Degree (as this accused was). IANAL

So, you're sure that the student in question was her 10th grade student and not one of the students she was in contact with in her role as basketball coach? The latter is a strong possibility, considering the actual charges she faces are second-degree sexual abuse, which under ORS 163.425(1)(b)(C) includes the clause "At any time before the commission of the offense, the person was the victim's coach as defined in ORS 163.426." if it's without consent.

You're welcome. He thought very highly of himself and was spouting things like "Ontogeny recapitulates phylogeny" decades after the theory was disproven. His feminist rantings weren't just directed at men. In fact, he got more vitriolic against women who didn't say "humankind", saying they were betraying their sex by saying "man". smh.

Carl Sagan was part of the problem. When someone used the term "man" for our species, he'd go into a long feminist diatribe about the term being sexist. Sagan was a fool and a tool who published a lot of junk science.
