Had the genders been reversed this woman would have been charged with assault with a deadly weapon, unlawful detention, and attempted rape. She would likely have been looking at 20 years. 3	Is the "short skirt/flirting = consent" argument actually used by people, or is it merely a strawman argument? Way to completely misunderstand and validate anon's point. They aren't saying that inviting a man into your home = consent. They're saying that inviting a man into your home is evidence for consent. Whether or not consent existed in a he said - she said case is determined by the behavior of the parties before and after the alleged incident. That's the only evidence the court has to go on. If you have sex with your BF because you think he might cheat if you don't, then i don't think that's rape.
