Really sounds like an exit affair. For the ones who don’t rationalize their actions by painting you as the villain - a mix of guilt and desire to be with the new person drives them to just want out on easy terms.

Push the divorce through as fast as you can. If she gets pregnant, your divorce will almost certainly be halted until the child’s birth and you may have extra legal steps to take to remove yourself from responsibility for the child because in many states being married to the mother makes you the presumptive father. Sure, you could get in straightened out in the long term, but it might mean months of your life and thousands more in legal fees.

The term "plenty" is meaningless, the reality is that men who pursue custody are almost always granted equitable access to their children. And I'm sure there are plenty of wealthy men who have successfully used the system to fuck over women as well. This is America. This sounds less likely a structural issue with family courts and more like you were just totally outgunned and outmaneuvered. Unfortunately, it is very hard to imagine any version of our system where a drastic financial advantage for one side doesn’t result in unfair outcomes. Regardless, I’m truly sorry you are in this position and hopefully your new counsel can do something for you. Honestly, outcomes like yours are why I opted to not have kids.

Men and women are different. They typically cheat for divergent reasons. This is why consumption of pornography, sex work, membership on sites/apps for seeking casual is skewed toward men by roughly an order of magnitude. Males simply seek sexual gratification w/o emotional attachment at vastly higher frequencies than women. Typically a woman who cheats is attached to her affair partner and detached from her spouse in ways that make reconciliation impossible or highly undesirable for her spouse.

What exact family court practice do you want changed? I think 50/50 custody is the standard in virtually all states now if men actually pursue custody. The reality is that men are disproportionately likely to have jobs which limit their ability to fulfill 50/50, so they don't pursue it. He is an adult and this is his family; he simply has a right to know. Also, given how his mom operated it is likely to get back to him regardless and now dad becomes complicit.
