It didn't. In fact another vehicle swerved to avoid her, then the motorcycle came and hit her. The vehicle was stopped, and she was out of her vehicle when the accident occurred. the fact that she didn't have her 4 ways on was an aggravating factor in the sentencing. This is the right decision. She was given a court ordered rehabilitation program, and she won't go to jail. I think the argument you intend to make is: Simply offering someone the opportunity to see you naked is not wrong. I have had sex with sober women in places far more embarrassing than a parking garage. My opinion is that "my rapist doesn't know he's a rapist" is so important. For her to make that assumption, I feel it implies that she was sober enough to speak reasonably clearly, give consent, and be held responsible for her actions.
