Just don't want $ from the parents to be split with her regardless of whether I ever pay it back. I assume to might be treated as a "gift" but we are in an equitable distribution state, so I'm concerned ANY $ I have would be considered, even if her name isn't on the account.

Yes. She did this even though it was only verbal, still for that black and white ride. Everyone thinks she had a plan ready to go for this. So far it's going her way... Not backing down, but playing her game. The "evaluations" she wants won't show what she hopes they will.

I feel like this system is so overloaded in favor of the mom's . My son has supervised visitation as a condition of dropping a TRO. Nothing physical happened, but he can't risk it. She wants her mother to be the supervisor. How awkward is that? Your situation is much worse. Asking her relative to supervise stinks, but it's better than nothing. Is that an option?

I think it will be cheaper to do this as a refinance than a sale, although I'm not sure. Pretty sure this is getting into needing a lawyer territory. The best way to structure it is probably to give him a loan. I will keep the show concept in mind though. I don't think gifts are marital property, however the existence of a large gift may factor into the" equitable" split concept. Although, she would be aware of such a gift and would probably hold out for a higher price... Ugh.

He wants to live there and the kids would visit, so she would know. I just didn't want her stopping us from helping.. Then i realized I was looking at it like a new sale, when it's really just a refi, so she wouldn't know if we gave him $. She can think he used his share of his 401k (how sad is that). It sucks that the house he got a good deal on will now be costing him more.

Divorce isn't filed yet, but she got a TRO (due to verbal fight) and doesn't seem to be backing down. She has a lawyer and they seem to indicate she will be seeking divorce. Trying to figure out scenarios how this could play out.

Thanks. I think I was thinking of it like an actual sale with a purchase agreement etc. Basically she has no say if we want to help him buy it. I don't think it can be hidden that we helped because she will know all the assets. Wondered if he should be converting any bank accounts to cash?

I'm sorry, due some reason this confuses me when I try to work the numbers. As I have written this reply it is starting to make sense though. I was thinking of it as a sale because of the expression about "buying them out." He is an adult with 3 kids under 10. He paid for the house but she is on the deed.. What if she's not working, but has some skills? Can they account for that? She was in same industry as son before kids, left that and got training for something else, left that at marriage time stayed home (COVID) and then had 2 more kids. Kids will be in K and 1st next year. Does Dad have to pay support if she chooses not to work?

What about a TRO for verbal fighting where she "thought he was going to attack her "-- I beleive witnesses heard it, but don't think they felt he was going to hurt her? The police were called this one time..Not a dad here, but a mom of one going thru hell right now. Stands to lose kids/house/ future jobs if RO stands. She could work but then he'll be stuck with day care. We are incredibly sad. Lawyer thinks she's going to go full throttle to divorce which was never brought up before.
