Depends on the state. NY, for example, you have to petition the courthouse and it can take a long time to get the court order for name change, which you need to change your license, ss card, etc. If you have a criminal record, nope. You also have to publish notice in a public paper. The court fee is over $200 in NY state. I would not recommend that she change her name in a common law state because if she decides to split from you later, she can use that as ammo against you.

Common law still exists in a number of US states (sorry, don't remember the exact number) and I'm glad it's not in NY (where I am). It's a largely antiquated idea and many couples do cohabitate in states with common law and don't have issues if they break up. I still wouldn't take that risk though because under common law, once you break up, IF someone is mad enough, they can take you to court and you will have to go through a "divorce" process and then divide assets and maybe pay alimony.

It's a raw deal. Even if you chose to have a series of temporary live-in relationships, be very careful.
