She should be getting fifteen years registration. Tier 1 registration is fifteen years, tier 2 is twenty-five years and tier 3 is lifetime. Those are federal guidelines adopted by all states about after the passage of the Adam Walsh Act. Either the facts are wrong or she is receiving less community control.

What's wrong is wrong, regardless of the genders involved. Most jurisdictions have crimes that cover underage "consensual" contact. In my state, it is called Gross Sexual Imposition and usually involves non-forced illegal contact. Yes, it's a crime, but it's a lot lower felony than rape and more accurately penalizes the offender.

I'd like to read the victim's statements to see how the DA concluded that a rape occurred, especially since one victim said the charges were ridiculous. I said this in a similar thread. Victim statements have a lot of pull in these cases. Sexually active teenage males are free to say what actually happened without being made to feel like they are ruining their lives. On the other hand, female victims are told they were raped, they are made to feel victimized and subsequently their statements to the court help with prosecution.

With genders reversed and everything else being identical, even the victim's statements? I would say the penalty would be similar. In reality, underage girls are made to feel ashamed of such activity and coerced into making less-than-honest victim statements. They would give statements saying they were preyed upon and it wasn't consensual. Giving a male teacher a much longer sentence and at least 15 years of sex offender registration.

The victims gave statements that the sex was consensual. The prosecutor's hands are tied at that point because it would be difficult to get a jury to agree to a harsher penalty. They didn't say in the article, but I would assume this is only a misdemeanor and she will not be a registered sex offender.

It's not a pass unless she was charged with lessor crimes than the male defendants. The victim's statements, video evidence and the incomplete investigation might be reasons that higher charges haven't been brought yet. Regardless of the charges, federal guidelines put in place after the passage of the Adam Walsh Act should make these defendants Tier 3 sex offenders, registering every 90 days for life.
