So as far as being blacked out, consent is assumed. And i mean literally uncouncious not just drunk . So consent is always assumed unless otherwise said? Also no definition of rape allows "regret" to be used as a reason. The legal definition is, through force, duress, threat of harm or otherwise lack of ability to provide consent. If you can find me the definition that does (legally) that opens another issue entirely.

My point is that one person (innocent) going to jail, where fifty guilty too sucks and shouldnt happen. What do you say about people who dont go immediately? Due to shock or shame or lack of worth etc? they just don't deserve any weight behind them because they didnt go instantaneously? Also, short of broken bones, there will never be "evidence" of consentuality as it is often displayed in mannerisms or vocal one on one discussion between the defendant and prosecutor meaning there is literally no evidence without some horrible injury, video, or contract.
