I think it is more men are checking out of marriage and anything that might legally tie them to a woman. It's not relationships per se, but rather the massive risk that comes with codifying that with a society that treats men as disposable, especially with regard to parental rights and economic fairness. Women often perceive this as men not wanting "relationships", rather than the men protecting themselves against a hostile society.

Not entirely, but largely, because while women control reproduction, men control their commitment. It's a large part of why men are checking out of marriage and relationships in droves. Historically low marriage rates, and from most sources it looks as though men are seeing modern women as unfit choices for marriage (less feminine, less fit, less loving, far more selfish and entitled). So there definitely is a push and pull that isn't one sided.

So exactly how does society do that? One way is by protecting our rights as sovereign individuals, of which due process is one of them. In the US it is against the law. Sex is a protected characteristic and discrimination by the government based on that is ILLEGAL. (Not saying it doesn't happen, and is often ignored, particularly when the wronged party is male, but it is technically illegal.)

It also violates due process. I'm not sure if Australia is the same, but in the US the government is barred from discriminating or punishing you for something you might do. Intent can factor into a prosecution, but it alone is sufficient for NOTHING. It's the same reason red flag laws and incarceration without an impending trial is unconstitutional.
