Unlikely it would be rape if both parties were that drunk, what with the whole power dynamic actually not being off (if they're both somehow "consenting") - rape is about power after all. Though I really struggle to see how two people who are barely conscious would have the wherewithawl to figure out how to have sex with each other. Usually when men are that drunk they can't get their equipment to work.
